Landlord and Tenant Adjudication
The Office of Residential Tenancies (ORT), often referred to as the ”Rentalsman,” is an independent agency of the Government of Saskatchewan responsible for administering The Residential Tenancies Act, 2006. This tribunal serves as the primary dispute resolution body for landlords and tenants in the province, offering an alternative to the traditional court system. The Saskatoon office, located in the Sturdy Stone Centre on 3rd Avenue, provides a venue for filing applications, attending hearings, and accessing information regarding rental laws. The ORT’s mandate is to balance the rights of property owners to protect their investments with the rights of tenants to have safe and secure housing.
Dispute Resolution Services
When conflicts arise that cannot be resolved directly between the parties, the ORT has the authority to adjudicate and issue binding orders. Common issues handled by this office include:
- Security Deposits: Disputes over the return of security deposits and claims for damages to rental units.
- Rent Arrears: Applications by landlords for unpaid rent and orders for possession (eviction) in cases of non-payment.
- Maintenance and Repairs: Claims by tenants regarding the failure of a landlord to maintain the property in a habitable condition.
- Notice to Vacate: Determining the validity of eviction notices and lease terminations.
Modernized Access and Hearings
The ORT has significantly modernized its operations, encouraging the use of its online portal for submitting applications and uploading evidence. Most hearings are now conducted by telephone to increase accessibility for participants across the province, though the Saskatoon office remains a critical hub for those requiring in-person assistance or document drop-off. Hearing Officers act similarly to judges, listening to testimony and reviewing evidence before issuing a written decision that carries the force of a court order.
Operational Details
The Saskatoon front counter is open to the public on weekdays but closes daily for a lunch break. It is important to note that staff can provide information about the Act and procedural guidance but cannot provide legal advice or act as an advocate for either party. Visitors to the Sturdy Stone Centre may be subject to security screening protocols.
