The Tribunal administratif du travail (TAT) in Gatineau is the regional headquarters for Quebec’s specialized labour and employment tribunal. Located in the Place du Centre complex at 170 Rue de l’Hôtel-de-Ville, this quasi-judicial body was formed in 2016 through the merger of the Commission des lésions professionnelles (CLP) and the Commission des relations du travail (CRT). Its primary mandate is to resolve disputes arising from the workplace, ensuring fair treatment for both employees and employers under Quebec’s labour laws.
Divisions and Jurisdictions
The Gatineau office manages cases for the Outaouais region across four main divisions:
- Occupational Health and Safety: The most active division, hearing appeals regarding decisions made by the CNESST concerning workplace injuries, occupational diseases, and compensation benefits. It also handles cases involving the right to protective reassignment for pregnant workers.
- Labour Relations: Adjudicates disputes involving union certification, collective bargaining complaints, and allegations of psychological harassment or prohibited practices in the workplace.
- Essential Services: Ensures that public health and safety are not compromised during strikes or lockouts in public services.
- Construction and Qualification: Resolves disputes regarding workforce skills and jurisdictional lines in the construction industry.
Dispute Resolution Process
The TAT places a strong emphasis on conciliation. Before a formal hearing takes place, parties are often invited to meet with a conciliator to negotiate a settlement. This confidential process is voluntary and free, often resolving issues more rapidly than litigation. If a settlement cannot be reached, the case proceeds to a hearing before an administrative judge, where evidence is presented and a binding decision is rendered. The tribunal’s decisions are final and can be enforced like a court judgment.
