Overview
Independent Quasi-Judicial Tribunal for Development Appeals
The Subdivision and Development Appeal Board (SDAB) is a critical administrative tribunal established by the City of Edmonton to hear appeals regarding planning and development decisions. Located in the Churchill Building in downtown Edmonton, this board functions independently from the City’s planning department, ensuring an impartial review of decisions made by the Development Authority and Subdivision Authority. Its primary mandate is to adjudicate appeals related to refused development permits, conditions attached to approved permits, subdivision applications, and stop orders issued for bylaw violations.
Hearing Process and Jurisdiction
The SDAB operates under the authority of the Municipal Government Act and follows strict principles of natural justice. Hearings are formal proceedings where all affected parties-including appellants, property owners, and community members-are given the opportunity to present evidence and arguments. The Board has the jurisdiction to uphold, overturn, or vary the decisions of the Development Officer or Subdivision Authority. Most hearings are conducted via video conference to ensure accessibility, though in-person options may be arranged. Written submissions are required in advance of the hearing date to allow for thorough review by the Board members.
Public Participation and Transparency
Decisions made by the SDAB have a significant impact on the urban landscape and neighborhood character. As such, the Board is committed to transparency. Hearings are open to the public and are often live-streamed. The Board publishes its written decisions, which outline the reasons for approval or refusal based on planning legislation and the Edmonton Zoning Bylaw. Residents who receive notice of a development appeal affecting their neighborhood are encouraged to participate, either by submitting a written statement or by registering to speak at the hearing.
Administrative Operations
While the Board itself is composed of citizen members appointed by City Council, the administrative office in the Churchill Building manages the intake of appeals, scheduling, and case management. The office provides procedural information to the public but cannot offer legal advice. Strict timelines apply for filing appeals (typically 21 days from the date of the decision or order). Failure to meet these deadlines usually results in the loss of the right to appeal. The facility is located near Sir Winston Churchill Square, making it easily accessible via public transit, including the LRT.
