Civil Dispute Resolution
- Monetary Limits: Located within the main courthouse, this division adjudicates civil claims for money or property valued at $35,000 or less. Common cases include unpaid invoices, rent arrears, breach of contract, and property damage. It provides a more accessible and less formal setting than the Superior Court.
- Settlement Conferences: A key part of the process is the mandatory settlement conference. Litigants meet with a judge or deputy judge to discuss the issues and attempt to reach a resolution without a full trial, saving time and legal costs.
- Self-Representation: While paralegals often assist, the system is designed to allow individuals to represent themselves. The court clerk’s office provides guidance on filing forms such as Plaintiff’s Claims and Defences, though they cannot give legal advice.
Service Hours and Enforcement
- Counter Availability: Please note that public counter services often operate on a split schedule (typically closed for lunch between 11:00 AM and 2:00 PM). It is strictly recommended to check current hours before visiting to file documents in person.
- Enforcement: Winning a judgment is only the first step. This court issues Writs of Seizure and Sale and Garnishment orders to help successful plaintiffs collect money owed from a debtor’s wages or bank accounts.
