Case Management and Resolution
- Prosecution of Offences: This office is responsible for prosecuting violations under the Provincial Offences Act. The prosecutors represent the City of Mississauga and the province in court proceedings, handling everything from speeding tickets to complex building code charges.
- Early Resolution Meetings: Prosecutors conduct meetings with defendants to discuss the evidence and the possibility of resolving matters without a full trial. These discussions can lead to reduced fines, amended charges, or withdrawals where appropriate, streamlining the court’s docket.
- Disclosure Requests: Defendants have the right to review the evidence against them (disclosure). The Prosecutions Office processes these requests, providing police officer notes, witness statements, and other relevant documents to ensure a fair trial process.
Interaction with the Public
- Professional Conduct: While prosecutors represent the crown, they have a duty to act fairly. They review files to ensure there is a reasonable prospect of conviction and that proceedings are in the public interest. They cannot provide legal advice to defendants but can explain the court process.
- Trial Preparation: The office coordinates witness attendance, including police officers and bylaw enforcement officers, ensuring that the prosecution is ready to proceed when a trial date is called in the adjacent courtrooms.
- Victim Support: In cases involving victims (such as careless driving accidents involving injury), the prosecutors may communicate with victims to keep them informed about the status of the case and the outcome of the proceedings.
