Expert Estate Litigation and Elder Law Services
Kimel Law Group is a boutique law firm located in the heart of Toronto, dedicated exclusively to estate litigation, estate administration, and elder law. Founded by Katherine Kimel, the firm provides specialized legal counsel to individuals and families navigating the often emotional and complex terrain of estate disputes. We understand that conflicts over wills, trusts, and the care of elderly loved ones are not just legal problems; they are personal challenges that require a sensitive yet firm approach. Our goal is to resolve these disputes efficiently, preserving both your assets and your family relationships whenever possible.
Resolving Estate and Trust Disputes
When a loved one passes away, the distribution of their estate can sometimes lead to conflict. Kimel Law Group offers robust representation in all areas of estate litigation. We assist clients with:
- Will Challenges: Contesting the validity of a will based on lack of capacity, undue influence, or suspicious circumstances.
- Power of Attorney Disputes: Investigating and litigating cases where a power of attorney has been misused or where there is a dispute over who should make decisions for an incapable person.
- Dependant Support Claims: Ensuring that spouses, children, and other dependants receive proper financial support from the estate as required by Ontario law.
- Passing of Accounts: Compelling executors and trustees to provide a full accounting of their administration and challenging improper expenses or financial mismanagement.
- Guardianship Applications: Helping families obtain the legal authority to care for a loved one who can no longer manage their own affairs.
Elder Law and Advocacy
As our population ages, the protection of seniors has become a critical area of law. We are passionate advocates for the elderly, fighting against elder abuse and financial exploitation. Whether it is recovering assets that were taken wrongfully or setting up legal structures to prevent future abuse, we stand by our senior clients and their families. We also provide guidance on long-term care issues and capacity rights.
Mediation and Alternative Dispute Resolution
Litigation is not always the best answer. We are strong proponents of mediation as a cost-effective and private way to settle estate disputes. Our team is skilled in negotiation, helping parties reach mutually agreeable solutions without the stress and uncertainty of a trial. However, when settlement is not possible, we are experienced litigators ready to advocate fiercely for your interests in the Ontario Superior Court of Justice.
Your advocate in difficult times. We bring clarity and compassion to estate conflict.
